Former East Bay teacher guilty of child molestation

(KRON) — A former East Bay teacher and cheerleading instructor was found guilty of child molestation and sexual battery charges, according to the Contra Costa County District Attorney’s Office.

Nicholas Moseby, 44, of Concord, was arrested in September 2022 after he was accused of sending an underage girl pornographic images. In the days after his arrest, more victims came forward in the case against Moseby, who worked as a biology teacher at Diablo Vista Middle School in Danville and a cheerleading coach for Nor Cal Elite in San Ramon.

Earlier this month, on Oct. 17, Moseby was convicted by Contra Costa County jurors of lewd acts upon a child and distributing lewd matter to a minor. He was also convicted of three misdemeanor charges, including two counts of child molestation and one count of sexual battery. The jury found him not guilty of one count of lewd acts upon a child under the age of 14 and deadlocked on another count of lewd acts upon a child.

On Wednesday, during the second phase of his trial, the jury agreed on multiple aggravating factors, including:

  • The victim was particularly vulnerable
  • The crimes demonstrated planning and sophistication
  • Moseby exploited a position of trust to commit offenses

A mother who said her cheerleader daughter was instructed by Moseby for four years told KRON4 at the time of his arrest, “This is the tip of the iceberg. This man has worked in the Tri-Valley for a decade, teaching hundreds of girls, of all ages. Elementary, middle, high school. There’s more to tell to this story. He’s a predator. He’s a pedophile. He never should have been hired anywhere.”

Moseby was fired from Nor Cal Elite after his arrest, with the cheerleading club saying it was “shocked and appalled by the allegations.”

Moseby remains out of jail on $300,000 bail. Sentencing is set for December 19.
