Poway voters to decide fate of embattled councilman facing felony charges

POWAY, Calif. (FOX 5/KUSI) — Poway Councilmember Tony Blain was set to appear in court Monday for his scheduled arraignment. However, he was not in attendance, and a motion for continuance was approved.

The arraignment was postponed until January 2026.

The District Attorney’s Office is charging Blain with four felonies and one misdemeanor over incidents between September of 2024 and July of 2025 — perjury, asking for a bribe, soliciting a bribe, destruction or removal of public papers and petty theft, according to the criminal complaint. If convicted, he could face up to four years in prison.

A notable attendee was Poway Mayor Steve Vaus, who said of Tuesday’s special election: “The voters of Poway are going to have their say.”  

Blain’s recall measure is still going to be voted on by the constituents of District 2 on Tuesday. If most voters decide yes, Blain will be removed from his seat.

Only voters living in the City of Poway Council District 2 are eligible to vote on the recall measure.

In addition to the ballot question on Blain’s potential recall for voters in Poway, voters throughout the state will decide whether to adopt Proposition 50, an amendment to the State Constitution related to redistricting.
